This website, freegrin.co (the “Site”), is owned and operated by MISWAK LIMITED, a company registered in Hong Kong SAR with its registered office at RM 10D R1, 10/F, Kin Ga Ind Building, 9 San On Street, Tuen Mun, Hong Kong (“Freegrin”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and your purchase of any products from us. By using the Site or placing an order you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy and Refund & Return Policy, which are incorporated by reference. If you do not agree, please do not use the Site.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) to purchase from the Site. You may browse and buy as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account, and you agree that the information you provide is accurate, current and complete.
2. Products
Freegrin sells natural personal-care products, including miswak (Salvadora persica) sticks, henna powder and cones, breath strips and related oral-care items. We make every effort to display our products accurately, but colours and appearance may vary slightly depending on your screen and because our products are natural and made from plant materials. All products are intended for personal use as described on their packaging and are not a substitute for professional dental or medical advice. Please read the product label and, if you have allergies or a medical condition, consult a professional before use. We may change, limit or discontinue any product at any time without notice.
3. Orders and acceptance
When you place an order you are making an offer to buy. We will send an order confirmation email; a contract is formed only when we accept your order by dispatching the goods. We may refuse or cancel any order — for example if a product is unavailable, if there is a pricing or description error, or if we suspect fraud — and will refund any amount already paid. Please check your order carefully; we may not be able to change or cancel an order once it has been processed for dispatch.
4. Prices and payment
All prices are shown in U.S. dollars (USD) unless otherwise stated and exclude shipping and any applicable taxes, duties or import charges, which are shown at checkout or are the responsibility of the recipient where noted in our Shipping Policy. Prices and promotions may change without notice, but the price charged is the price displayed when you place your order. We accept major credit and debit cards, PayPal and other methods shown at checkout. Payments are processed securely by third-party payment processors; we do not store your full card details. By providing a payment method you confirm that you are authorised to use it and that the payment will be honoured.
5. Shipping and delivery
Shipping options, costs and estimated delivery times are set out in our Shipping Policy. Delivery times are estimates only. Title and risk in the products pass to you on delivery to the address you supplied. Please make sure your shipping address is complete and correct; we are not responsible for orders delivered to an incorrect address that you provided.
6. Returns, refunds and cancellations
Our Refund & Return Policy explains how to return an item and when a refund will be issued. In summary, you may request a return within 30 days of receiving your order for unused items in their original packaging; for hygiene reasons opened personal-care items cannot be returned unless faulty. If you live in the EU or UK you have a statutory 14-day right to cancel, subject to the hygiene exception for unsealed goods. Nothing in these Terms affects your statutory rights as a consumer.
7. Promotions, discount codes and newsletter
Discount codes are single-use per customer unless stated otherwise, cannot be combined with other offers and have no cash value. We may withdraw or amend any promotion at any time. By subscribing to our newsletter you agree to receive marketing emails from us; you can unsubscribe at any time using the link in each email.
8. Intellectual property
The Site and all of its content — including the Freegrin name and logo, text, product descriptions, photographs, videos, graphics and design — are owned by or licensed to MISWAK LIMITED and are protected by copyright, trademark and other laws. You may use the Site for personal, non-commercial purposes only and may not copy, reproduce, distribute, modify or create derivative works from any content without our prior written permission.
9. User content and reviews
If you submit a review, comment, photo or other content, you grant us a worldwide, royalty-free, perpetual licence to use, display and reproduce it in connection with our business. You confirm that your content is your own, is honest, does not infringe anyone’s rights and is not unlawful, offensive or misleading. We may remove any content at our discretion.
10. Acceptable use
You agree not to use the Site for any unlawful purpose; to interfere with its security or operation; to introduce viruses or malicious code; to scrape, crawl or copy the Site without permission; to impersonate another person; or to buy products for commercial resale without our written agreement. We may suspend or terminate your access if you breach these Terms.
11. Third-party links and embedded content
The Site may contain links to, or embed content from, third-party websites and platforms such as TikTok. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free or free of viruses. Statements about our products are for general information and are not medical claims. This does not affect any warranty implied by law that cannot be excluded.
13. Limitation of liability
To the fullest extent permitted by law, MISWAK LIMITED and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of or in connection with your use of the Site or the purchase or use of any product. Our total liability to you for any claim arising from an order shall not exceed the amount you paid for that order. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold harmless MISWAK LIMITED and its affiliates from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
15. Privacy
Your personal information is handled in accordance with our Privacy Policy.
16. Changes to these Terms
We may update these Terms from time to time by posting the revised version on this page with a new “Last updated” date. Changes apply to orders placed after they are posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without prejudice to any mandatory consumer-protection rights you have under the laws of the country where you live. Any dispute that cannot be resolved amicably shall be submitted to the non-exclusive jurisdiction of the courts of Hong Kong SAR. If you are a consumer in the EU, you may also use the European Commission’s Online Dispute Resolution platform.
18. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them to a successor of our business. These Terms, together with the policies referenced above, form the entire agreement between you and us regarding the Site.
